The MaxCollect process

The MaxCollect process puts you in control of all recovery efforts.You are in control The process begins with client input or upload of account data. As each account is received, a database entry is made, optional delinquent billing fees may be added (at your request), and MoneyQuest begins mailings on your behalf.

The debtor sees a big difference. Instead of receiving “just another” bill, the MaxCollect contact is backed by the impact of an Attorney and the Credit Bureau.

  • The first debtor contact, sent under your name and address, is very diplomatic. It states that you value the relationship, and (at your option) may indicate that delinquent billing fees are now also due. (This fee is designed to eliminate the processing cost.) The letter requests that the debtor pay immediately, or call if there are questions or disputes.
  • Fourteen days later, the next contact letter is automatically trigger. It is also sent under your name, and states that you feel compelled to advise the debtor that this account may be reported to the Credit Bureau. Debtors are told that “we have always dealt in good faith” and you now ask for theirs in resolving the account.
  • On the twenty-eighth day (the third contact in the first month), your next letter tells the debtor that it “appears” they have no intention of paying and that you “must consider sending the account to an agency or our attorney for intensive collection effort.”
  • The final demand letter says the account may go to the credit bureau, and, if not paid in ten days, it will go to your attorney. This is followed by an automated client telephone call.
  • The account is then automatically forwarded to your Retained Attorney, in accordance with a direct retainer agreement that you sign as part of the program setup. Your Attorney then makes three written demands, before beginning telephone calls and other actions. Where else could you get all this for a fee of 5%?
  • A signed final legal demand is sent by your Retained Attorney, along with automated telephone contacts, before the Attorney begins taking more direct action. These are last-ditch efforts to resolve the matter, before considering the additional cost and effort of litigation.
  • Eventually, should the debt remain uncollected, the account may, at your option, be litigated or forwarded to the Credit Bureau. If you decide to litigate, you will benefit from your Retained Attorney’s preferential rate when working on your behalf. Note that MoneyQuest does not share in any fees with the Attorney; this activity is strictly between you and your Retained Attorney.
